MCRB Submits Comments to the Hluttaw on the Bill concerning Artisanal Oil Production

On 8 June 2017, MCRB made a written submission in Burmese to the Pyidaungsu Hluttaw Joint Bill Committee on the Artisanal Oil Production Bill. The bill is currently under discussion in the Hluttaw (where the precise title of the Bill is currently under discussion).

MCRB’s submission (in Burmese) highlighted seven concerns which were focussed on simplifying the proposed complicated licensing process for artisanal oil drilling and production to meet the local context of artisanal oil workers.

These focus on Chapters 3, 5, 6, 7, 9 and, 10 of the Bill. Suggestions include: introducing a realistic taxation system that is suited to the situation on the ground; ensuring protection of the rights of artisanal oil drillers; and reduction of heavy penalties. MCRB also proposed that the government should take more responsibility for handling land disputes and protect the right to livelihood of artisanal oil workers. MCRB also questioned the proposal that these workers, who themselves live a subsistence existence should have to provide funds for socio-economic development/’CSR’. MCRB has conducted a Sector-Wide Impact (SWIA) on Oil and Gas in Myanmar. These comments on the Artisanal Oil Production Bill are based on field research findings from work in Oil and Gas Sector including in Magwe and Kyaukphyu.
